Trademark FAQs - related questions & answers

Question: What is popose of the trademark law treaty?

Answer:
The TLT was enacted to simplify procedures in the application and registration process and to harmonize trademark procedures in different countries.

Question: Can a minor file a trademark application?

Answer:
This depends upon state law. If the person can validly enter into binding legal obligations in the state, then that person may sign a trademark application. Otherwise, a parent or legal guardian must sign the application, clearly setting forth their status as a parent or legal guardian of the applicant

Question: How are characters like a hypen treated in a tradmark?

Answer:
The pronunciation of the trademark is the most controlling factor. So whether or not similar marks have dashes separating elements of one or the other mark wouldn't make much difference in deciding.
